29-year-old David Messina on Friday after he was involved in a domestic incident earlier in the week. Pursuant to the Dutchess County Family Court order, Messina, a Crosby Court resident was required to vacate the residence and surrender his weapons.

The officers that were serving the order, according to Schettino, found an assault rifle and 17 “high-capacity” loaded magazines for the weapon, that he did not legally possess. He was also in possession of a tactical shotgun, several edged weapons, ballistic vests, a ballistic helmet, and a substantial amount of ammunition.





Not sure what the "domestic incident" was, I 100% strongly condemn abuse but this guy's life was just ruined (perhaps by a once trusted scorned lover) and his possessions that are legal in most every state are now confiscated as well.

This could just as easily be a member from the forum. They're making him out to be unhinged because of his possessions.

Also what was the point of the ammo, the helmet, vest, etc being mentioned? None of those are illegal in NY by any stretch.

The question is how do we fight to get the police to do the right thing here without being demonized ourselves? I'm not sure there is a really good answer. The moment you pipe up, you're just as "unhinged" as they label you to be, even though all we want is the preservation of a right we have.

Here we don't. We won't hear about it. There's nothing we can do to campaign for or to educate many officers here or those who know LEOs openly say many of their fellow cops are not "gun guys" nor take their oath seriously and don't think civilians should have guns. You just hope if you ever get jammed up that the responding/observing officer uses judgement and discretion and perhaps looks the other way and honors their oath. I'm sure this happens but obviously we're not going to hear about it.


Better yet move somewhere that law enforcement has an engrained attitude of being pro-civilian-gun ownership

So drinking my coffee this morning, I dug into this a bit. Apparently there are services that will make the FOIA request as an org and get the documents for you.

I assume this is legal, but I need to confirm. There may also be a cheaper way, but there definitely seem to be a few out there.

I think this is worth our time to investigate. Let them know the people are watching them.

It would seem the Court knew he had weapons.

You don't need to be anonymous. It's public record. And unless you have a relationship with the higher-ups in the local PD and this FOIL would cause trouble, nobody gives a crap.

Kind of like it would be overkill to hire a lawyer to take out a library book for you.

I wish we lived in a perfect world in which the police would not honestly care if you make a FOIA request, but I don't want people asking me questions (nor would I answer them without an attorney.) I don't want that cop breaking my balls about other shit down the line because I'm the FOIA request guy asking a lot of questions about their unconstitutional seizures.

If the FOIA requests don't require we be IDed, then I suggest we use the system to our advantage and find a way to do it anonymously.

They don't have a special form on the FOIL request for "Is this request regarding an unconstitutional seizure?"

You say you want every available record concerning (name here) between (day before event) and (day after event). I guarantee his wife's lawyer, wife's family, his wife, and likely his lawyer, his family and himself have already FOILed the records.

I'd be willing to bet filing a FOIL request won't put you on nearly as many lists as, oh.... buying a gun, or registering a car or voting.

And for the record, I have filed FOIL requests. There was never any follow up and the first time I did it, the nice lady at the police station told me to request the records electronically so there wouldn't be a per page fee.

And how buy this article do you come to the conclusion that this was a unconstitutional seizure, and not just because you don't like it!!

Police Lieutenant Paul Schettino said that officers were serving a temporary order of protection on 29-year-old David Messina on Friday after he was involved in a domestic incident earlier in the week. Pursuant to the Dutchess County Family Court order, Messina, a Crosby Court resident was required to vacate the residence and surrender his weapons.

Because things like high capacity magazines, and grips, and all that crap isn't forbidden by 2A. It's just a bullshit policy that Karens made up to put republicans in jail.

It's a policy with teeth, but I will always consider it to be a violation of the constitution.

Also, I very much want to know what grounds they are charging him on / what gave them grounds to tack on all these charges. There seemed to be some incident, but he wasn't actively committing a crime at the time they gave him the restraining order.

That aggravates the shit outta me. They have no business taking those items(really no items should be taken but we are stuck with unsafe act regardless if we all know its unconstitutional). Surprised they didnt mention taking his camo clothes, targets, portable tree stand, sand sock, etc... why stop there..
