You honestly think that will stop them? All they need to do is find a judge that will allow them. They will never let laws or the Constitution get in the way of their need for revenue.

They'll just borrow against it as collateral or something like that.

Then eventually they defaults and it disappears.

Since nobody ever prosecutes government agents when they break laws like that, they have no reason to actually worry if it's illegal or not.
