Apparently the knife was an "illegal" knife.Of course they charged him with the knife,he resisted so anything they can charge him with is included.Police anywhere will rarely cut you a break if you are uncooperative or resistive.
I missed the part where it said it was a folding knife.The story gives very little info,basically said he was "threatening employees",was he threatening to stab them? Who knows,but even if the knife wasnt a per se weapon,its typical to charge a perp with everything you can and let the lawyers hash it out later.The fact that he resisted also doesnt lead to any breaks from the AO.

NYPD flick?Never heard that term.I made hundreds of gravity knife arrests in NYC.If a knife can be flipped open and lock with one hand,its a gravity knife.Not all folders can be opened as such.Whenever we had someone with a gravity knife or otherwise illegal knife we'd always give them the opportunity to tell us they didnt know it was illegal and agree to surrender it,in which case we'd voucher it as found property.You'd be amazed at how many refused and basically told us "you have to lock me up or give it back".
If you hold any locking folding knife by the knife end and flick it open as hard as humanly possible and it locks, then I suppose almost anything is a gravity knife.

You hold it like its supposed to be held and flip your wrist. If it doesn’t open and lock, it’s not a gravity knife.
Not sure if its changed,but in NYC if a "basic folder" was over 4" it was an AC violation and you could be summonsed.Back in the 80's,when I was working,the popular knives were the big,cheap 007's,every mutt had one in his back pocket.When sold,they werent gravity knives but you could work the blade side to side to loosen it in the handle making easy to flip open.Agreed that makes sense and seems reasonable.

Here’s my gravity knife. Been carried for 20 years. It’s always gravitated to my lower right ass cheek. You couldn’t flick this open if your life depended on it. Don’t know why anyone would need to carry anything larger.
I’m sure some of you are commenting on the stains. I wouldn’t have it any other way.

Like Airborne says,there might be guys that try to do things like that,but I can tell you from experience that if you "fake" a gravity knife,when the person pleads not guilty and you end up in court you will have to demonstrate on the stand that the knife is indeed a gravity knife.People talk about that all the time because they just like to complain about cops. I'm sure there's guys out there who do stuff like that, but bring that explanation to a DA and your arrest is in the trash before you can sign in to court.
