Two U.S. citizen children were sent on their mother’s deportation flight to Honduras without the opportunity to speak with attorneys, leaving a 4-year-old boy with Stage 4 cancer without access to his medication, according to the National Immigration Project. Gracie Willis, an attorney with the organization.

U.S. District Court Judge Terry Doughty has ordered a May 16 hearing on the case, writing that he has a “strong suspicion that the government just deported a U.S. citizen with no meaningful process.”

They deported them without due process. These are us citizens, not illegals. Very different things.

i want to see the deportation order for the KID/KIDS they were so called US citizens .. i bet there is none and the kid/kids went with the parent/s ..

The kids werent deported, the mother was. The kids went with her, as it should be. They are not adults, they have to be in the mothers care til they are of age, then they can come back. Being a minor, doesn't the parent have to be there for the discussion also?

I read that for each of these 3 children, adult family members here in the US legally were approached about taking custody of the child and all declined.

But the process that is due for a illegal to be deported is drastically different than the process to imprison a criminal citizen.

You don't get a trial before deportation. Never have.

Think of it this way.

Anyone can be arrested and thrown in jail based on a single police officer merely thinking there is probable cause that they committed a crime.

The standard for deportation is about the same.

You get a trial and all that, but not until *after* you spent time in jail. You're not even guaranteed to *see* a judge to talk about bail for 24 hours or more.

If you're not guilty of the crime, you are entitled to a trial and all sorts of due process to find that out.

With deportation, that just happens in another country. If you aren't here illegally, then you have ample opportunity to plead that case and be allowed back in.

Just like you get a trial, but you sit in jail till it happens, you have a process to re-enter the US as well, you just sit in the other country while it happens.

Now, getting deported when you're a legal resident would suck for sure. But I'm not sure it's worse than spending weeks or months in jail waiting for a trial.

The government *should* compensate both parties for it's error in those cases, but I'm not sure there is a good argument for why the Deportation case is worse

Perhaps I'm wrong (it was a long time ago in a High School classroom where I was more interested in the girl beside me than the subject) but we were told as Minors, that we really did not have "Rights" and when you look in the proper context, the Teacher was correct, and why your Parents/Guardians were responsible for your actions.
I still contend that the age of Legal Adulthood should return to and remain at 21.

As minors we have no authority to take them from the mother to keep them here as citizens, they cannot make any decision about staying or going until they are of age. So they stay with the mother. And if they'd made the kid a ward of the state so that he could stay, then people would be up in arms about them being separated.

Presumably the kid *could* have stayed, if that's what the family wanted. But the mom was going with or without him.

The process that they are due hasnt changed. Biden didn't want to deport many, but the ones he did got the same process Trump is using.

The constitution differs. All US citizens have a right to remain in the country, barring extradition for a crime, even then it goes through courts. Your parent not being a US citizen isn't YOUR crime, and no citizen is responsible for others crimes, just your own.

You're not wrong, but i don't know why you think they weren't offered that choice.

How many mothers do you know who would choose to give the kid up to the state under those circumstances ?

The kid has citizenship, he can come back whenever he wants.

If it was you in that situation, wouldn't you choose to keep *your* kid with you ?
