I've seen lots of people *say* that, but I haven't seen any actual proof.And even so, especially since he seemed to already be disarmed, there was no reason to use lethal force.
They show a grainy video of an agent with a gun, but I have not seen anything that proves that was the gun that Pretti had.
On top of that, the standard for self defense (as we all know) doesn't require him to have been an actual danger, just for the agent that fired to have had a reasonable fear of serious bodily harm. So, if the agent who fired can make a case that he reasonably believed Pretti was still armed and attempting to fire, that is enough. It doesn't actually matter if another officer had control of the gun at that point.
