Gotta love the “purchased in NC, but not legally possessed”. Not legally possessed in NY apparently? Poor Otis. His parents should have named him Hunter Biden.

Same here. I guess the guys who arrested him thought differently though...I'm also curious about "They found a marijuana cigarette next to the driver, identified as 25-year-old Otis Jones." I thought it was legal, and not a reason to search a vehicle.
So being in the possession of a joint means he's intoxicated? Hmmm... no DUI charges in the article. Not legal to drive in NYS while intoxicated.
Pretty clear about possession of more than 10 round mags .........and no NYS CCpermit.
Whats the beef....we do not do this shit.

There is no “test” they can do to determine if someone is CURRENTLY high on Mary Jane. The shit stays in your system for 30 days. So he can’t be charged with DUI unless was seen smoking it while driving or car filled with smoke, etc. And it’s legal to possess, so it cannot be used as probable cause.V&T traffic violations...........
I suspect he was tested later...........
The gun charges sink him anyway. He was not stopped for the joint...but for his vehicle or driving.
"Probable cause" may be tested in court, but likely valid.
Not anywhere near a lawyer, just my understanding of the lawThere is no “test” they can do to determine if someone is CURRENTLY high on Mary Jane. The shit stays in your system for 30 days. The smoking joint in the ashtray, likely did the dirty deed. Most smoke them and then toss the end....

Gunowners who smoke pot will be disqualified by the Feds and the State from gun ownership, especially when the SP do the NICS check. It is a plot...don't fall into it by smoking pot behind the wheel,or having a ghost gun on the seat.
Perp will do state time for his illegal possession of a gun. There is no full reciprocity between states yet on gun possession. Eventually, maybe in time. I can travel in NYS with a gun, and do, and some other states.
What part of the law about illegal possession of a gun in this occupation state, do you not understand? Piss and moan piss and moan..............
The law has been in place for over 100 years in NYS, and only Bruen helped us, who already had a permit....this guy was just...............dumb or a drug dealer; don't be that guy.
Libertarianism and sovereign citizens who fight the Constitution longing for the days of 1785 are
a pox.
I myself, like the Fed system as designed, but not as ruined by the Libs and Dems.......my entire career was spent supporting the system and voting Republican since 1968.
Join the club............you own guns right? Whats the problem?
Don't be these guys...........

Tell me that the DHS, FBI, NYSP, are not watching.
You've obviously never been around people who smoke pot. Most smoke them and then toss the end....
You sound like the guy blaming the girl who got raped because her skirt was too short. The smoking joint in the ashtray, likely did the dirty deed. Most smoke them and then toss the end....

I've known some very smart people who turned into pot heads, and it had exactly the effects on them that you describe. It is generally pretty ez to determine if someone is high!!!
Pot smoking impairs good judgement, and this guy exhibits all the effects of bad judgement for sure!!

Crash rates jump in wake of marijuana legalization, new studies show
New research from IIHS and HLDI confirms the trend, but a separate study of injured drivers found no increase in crash risk from the drug except when combined with alcohol.www.iihs.org
I knew a guy who quit when he began forgetting small things like his wallet, keys, putting on a belt..he blamed weed..........after 6 months off it he said it was definitely weed, as it took him 2 months to finally get a really clear head, and the syndrome never came back.
Another professional guy I worked with was a real head....slow walk, drawling speech--definite a pregnant delay between asking him a question, and his response....always high.
He was arrested in 1978 in Vienna NY for having a barn full of pot...hundreds of pounds.....pretty smart???
But SP did not have a valid warrant....but they likely knew that but wanted the pot off the street....guy got off scott free, except the loss of the pot......which was a hell of a punishment...probably not his pot. He lived thru the ordeal.
Short fuses and impatience are pretty common when chronically using pot....
It is its own punishment for sure......smoke up, tune out............
I've known people who smoke pot occasionally. They're like you say.And I know extremely hard working people, and professional people, who you would not know smoke pot. It's never changed their work ethic or who they are as people.
I am afraid at age 75, I have seen quite a number of my peer group....college educated professionals, who used pot chronically, blow up likely from their pot use.
2 lawyers..one from a very prominent family of Judges and Lawyers............totally mostly incompetent party-er....lost job after job....could not concentrate on law..ended up as Gov't Lawyer for the Ag dept.
Another--- Masters Degree in engineering from UCLA--- could not concentrate--short term fuse and memory and left most jobs after 6 months...worked in oil fields, for State of Fla, NYS, a College..... and then as poverty stricken installer of storm windows..hung himself in prison after a ill advised idea he could launder drug money for .......Feds got him cold....
Another, I knew well, Lawyer had such a short fuse that he beat up a kid stealing corn from his hobby farm produce stand..made NYtimes...lost his judgeship and law license in long run.
Another masters Degree Rehab counselor-- a director at a State Institution... was so high and short tempered most of the time, he got into fights and was finally given an early out by State to go home for mental defect, and grow pot. Died at age 59.
Another pot advocate friend, a one time drug counselor, was a bad role model for his kid and his kid died of drug OD. shattered this guy and he today warns against pot use.
Another master electrician locally, did the same and his daughter...smoked with her like libs do,.... died of OD too, leaving 4 kids.. She wanted drugs more than the kids, she told the court.
3 other guys died within 4 months of each other.....all pot smokers and same age....WTF??? Bad pot?
I could go on and on, but the party guys will never believe me.
It is long term suicide to use it, but I do not really care at all................................ PLEASE use it, as an experiment to prove me wrong....
I am sure there are many more examples out there of destroyed careers and lives that I simply do not know about.............the pattern exists.
Technically, it should mean that the prohibition would have to be explicitly added as part of the sentence."Again, Mr. Bullock presents an as‐applied challenge to § 922(g)(1). He contends that the charge against him, and him only, should be dismissed because “the prosecution has failed to establish a ‘historical tradition’ supporting lifetime crimi‐ nalization of [his] possession of a firearm.” Docket No. 64 at 9. The Court agrees. In plain English, that means that the charge against Mr. Bullock will be dismissed today, and the federal government may continue to prosecute other persons for violating § 922(g)(1).33"
CA and NY are an absolute NO to non-residents applying for a CCW permit, and a few of the other anti 2A states are almost as bad. Handgunlaw.us is a great resource on that. Hell, even those of us with NY CCW's issued outside of NYC cannot carry in the 5 boroughs.@Zerex do you not believe in universal pistol licence reciprocity?
It's completely ridiculous to have to get licenses for every state. It's also completely ridiculous that NY makes it completely impossible for a non state resident who has never possessed a NY state pistol licence from prior residency to obtain one to legally carry a pistol in this state.
This state and their laws are the problem.
It should be just like a north Carolina issued driver's licence. Good for all 50 states.
NC recognizes my NY license and it should go both ways. In fact NY is so far to the extreme they actually make it impossible to exercise a right to non state residents. That's the problem.
The purple tie boys were fishing looking for a reason to jam this guy up. Is the guy a crim, a loser, a druggie? Maybe or probably. Should he be facing the charges that he is? No.
