Which is why I never liked the "in common use" idea as a means to protect something.
Anything that is "new" would never be able to reach the "in common use" level.

The solution to that is to realize that "common use" doesn't exclude police or military either.

If every cop carries them, then they are in common use, even if nobody else does.
