Came across this honest young man on armslist
ARMSLIST - Want To Buy: Looking for Glock 19 non FFL

Copied text for when it gets removed.
"I just got my pistol permit but I am under 21. I can explain to you how that is if you're interested. Anyway I can't buy a pistol from an FFL until I turn 21 which is in 2 years. Though I can buy one from a private party before then. I am looking for a Glock 19 or 43 I'm willing to drive. Give me a call or preferably text 5853718818"

He is kinda screwed. Maybe he could co-register. The issue is even a private sale must go through and ffl in ny. The feds will not allow under 21 to buy anything except rifles and shotguns.

You can posses handguns under 21, you cant buy them from an ffl.

I got my NYS pistol permit just before my 19th birthday. At the time, you could. You just couldn't buy from a dealer unless you were 21. So I went to Dick's, picked out a S&W 60, put it on lay-a-way. Gave the info to a buddy of mine who was 21+ with a permit. He got the purchase coupon to pick it up from Dicks. I got my coupon to get it from him around the same time. We went to Dick's, I paid it off. He picked it up on his permit and gave it to me.

Excerpt from NYS Penal Law 400:

1. Eligibility.  No license shall be issued or renewed pursuant to this section except by the licensing officer, and then only after investigation and finding that all statements in a proper application for a license are true.  No license shall be issued or renewed except for an applicant (a) twenty-one years of age or older, provided, however, that where such applicant has been honorably discharged from the United States army, navy, marine corps, air force or coast guard, or the national guard of the state of New York, no such age restriction shall apply.

If he indeed actually has a permit, why would he have trouble buying a handgun from an FFL?

You go to the shop, they ask to see your permit, you show it to them and you buy a gun. Unless it's a federal law, what's the problem?

I know that. As I said very few. Don't know a lot of 2 year enlistments lately. Maybe it's an army thing still. Prison to a two year hitch :)

Federal law requires you to be 21 to buy a handgun or an other from an FFL

I think the statute of limitation has run out.....maybe not.........straw purchase??????....... watch what u admit to online......

My friend got his purchase coupon from the county to give to Dick's when he picked up the gun. I had my purchase coupon to give to him as if I bought it from him. It had already been added to both permits. He just had to go the next day, turn in my coupon, and have it removed from his permit. Of course this was 1984. things were a little different then.

Funny thing is, I sold that gun in the late 90's. It wasn't until then that it was found that they had used a part number, rather than the serial number, to record everything.

Somewhat off topic though, Orange County told me that if I wanted to sell a handgun to another Orange County permit holder, it did NOT have to go through FFL, just a bill of sale from me so they could put it on their permit.

That is wrong.

Penal code (i m looking for it) and the ny safe act says otherwise.

I am looking for the penal code. Without a penal code it may not be against the law......hhhhhmmmmm?

But in a free state, somebody over 18 and under 21 could still make their own from an 80% right? Or get one from somebody where there'd be no "straw" accusations? (Dead guy's estate sale, etc.)

Yeah but, then that would be a felony not only for the buyer but also the seller. Federal law prohibits buying handguns and other and taking them home in states other than your residency state. Out of state purchases of anything other than long guns have to go through an FFL in the state of residency.

Yes. An 18 yera old can buy privately where not prohibited by law. Or receive a gift. Of juat borrow one. Not illegal to posses, only to buy from ffl. Hows that grab you? Dumbass govt.
