Where did you find the indication of why it was denied?

ETA: @Deplorable Me , to clarify; What did you find that indicates that it "Appears that it wasn't properly presented."?
I haven't found any explanations for the denial, but would like to read them if they exist.

Pages 14 thru 16 are about an entirely different case, aren't they (DON BLANKENSHIP v. NBCUNIVERSAL, LLC, ET AL.)?

23A230 GAZZOLA, NADINE, ET AL. V. HOCHUL, GOV. OF NY, ET AL. is the case we are watching. The only mention of this case (that I see) is on page 1:

This is exactly why I never get my hopes up about these lawsuits. Even when they side with us ala Bruen, they just find a way around it as we saw here with the CCIA. I really have little hope anymore that the 2A will survive, I dont know what the solution could be, but apparently the law and Constitution are dead.

^^^^^So true. I will not ever give up but I’m also a realist. Certain people on here were saying “But Bruen, but Bruen ……” and that we’re naysayers, , for lack of a better term. No , we just see through the bullshit. As long as there are no repercussions for states blatantly circumventing SC rulings, it’s a lost cause. Unless politicians and legislators are held accountable for passing unconstitutional laws, nothing will change. And if anyone here thinks that NYS, sorry NFS (no fun state) will just sit back and let you exercise your 2nd amendment rights like the majority of other states do , needs to get their heads out of their asses and wake up.

As gun owners we have two main problems, other than the obvious Albany issues...
1) we're out numbered by non owners.
2) not enough gun owners and or non gun owners give a shit about 2A rights.

I have to admit, my view is pretty sour. Gets more so with every BG check. I had a glimmer of hope, not so much.

Here is an excerpt from the email I recieved from Paloma A. Cappana (hope it is ok to list here)

SCOTUS: “Denied.”​

This morning, as part of the case conference announcement packet, the Plaintiffs and I learned that our “Emergency Application” to the Hon. Justice Clarence Thomas of September 12, 2023 was denied. There was no accompanying statement or opinion. The denial neither grants our request for relief, nor expressly supports the defendants’ actions.
As a procedural matter, the broader motion from which the 3-prong sub-motion was derived is still pending at the Second Circuit. We now likely must wait until whenever the Second Circuit panel judges decide to rule on our broader motion for preliminary injunctive relief. In the context of the lawsuit as a whole, this motion is “just” the first motion in the case.

Well... The founders didn't create those Rights, they just recognized them... Our Rights are not defined by paper, or gavels hitting the bench!

Unless you can build your own from raw materials apparently no company will sell to us here in New York, even companies from actual free states.

I can't say I'm surprised the S.C. refused to enforce their own rulings. That dog apparently hasn't had teeth in centuries.

The interwebs are expansive and full of companies that do not give a shit. I am very confident that I could have anything that is legal elsewhere shipped to an address in NY.

I got an email from the atty, as I contributed $25 bucks.

Denied, with no opinion or documentation at all...............sent back down to the 2nd Circuit Court that has totally ignored Bruen.............if 2nd Circuit refuses to act it may take decades.............

Something has to break at SCOTUS.........

I don’t understand why every person in America doesn’t have standing for this if that’s their issue. Anyone can come to nys and buy ammo so it impacts every citizen 18 and up.
