Problem is, the NY lawmakers also read the Thomas decision and in their opinion the new carry restrictions are in line with it. Thus why it will need to go back to SCOTUS to define what is and is not allowed, specifically. Otherwise you're just getting other peoples views on what the decision...
NYSRPA v. Bruen and the Future of the Sensitive Places Doctrine - Boston College Law Review - Boston College
This really explains a lot of the historical sensitive places.
Bad news for us. Lots of history of gun bans and sensitive areas.
I. The Historical Scope of the Sensitive Places Doctrine
Historically, the sensitive places doctrine has gone well beyond the narrow category suggested by Justice Alito’s question and advocated by Halbrook.10
Starting at the...
Seems as sensitive areas were indeed discussed in this case, despite what the resident comedian has claimed.
Justice Alito, who posed the following question to petitioners’ counsel at oral argument:
So starting with that, could we analyze the sensitive place question by asking whether this is...
Oh look, another joke. Who could have seen that coming? Im here to have serious discussion on this specific topic. Not slap stick comedic attempts. Sorry.
I was being facetious. I think the state legislator that was being interviewed on a radio program probably has a better grasp of the situation than some random guy on the internet that likes to post goof ball stuff when others are trying to have a serious adult conversation.
Maybe, if so you probably just threw your pistols in a bin out front and retrieved it when you left. I saw something to that effect on a show I watched once. Who knows if its accurate though.
Then I guess the law will stand as written. Thank you. I can now sell my pistols as they can not legally be carried virtually anywhere after September 1st, and are sub-par for home protection.
Maybe, but it is vague and the lawmaker that was on the radio was outlining some of this. Somewhere, someone will need to clarify what areas can be sensitive, or else they all will be as they are trying to do now. Actually I should say as they have done now because the law has been passed.
I heard someone on the radio say that it might have to go back to SCOTUS so they can define what sensitive places are. Like maybe just a supporting document to clarify.
What about the prosecutors? Couldn't a 2A friendly county just not prosecute people? Or how about the police grow a pair and ignore the unconstitutional laws?
Oh and we cant carry at a restaurant either anymore? Every place other than maybe a diner or something has a liquor license. 95% of all restaurants I bet. So I guess im not going out to dinner anymore or taking uber. Assholes. All we can hope for is legal challenges and maybe the law will be...
I haven't been here in a few days, too busy with work and 4th of July "sales". But a few things, the training is for new applicants as well as those that have to renew. The bill says something along the lines of "shall be rectified or renewed in the same manor" as applying for the original...
Doesn't work that way. The complaint is you were suspicious. The pat down is completely constitutional. Its been upheld over and over. Any encounter. Pat pat pat. No weapon, no problem. Again, its not a search.
It has been posted before. Please pay attention. Where do you think myself and others here posting got it? I am not going to cater to a specific individual who doesn't "get it". Thats one of the problems in our society these days. Keep playing the victim. We do not care.
Someone here posted it already. Scroll up. Do you not know how to look for yourself? Its the senate bill. Not something written on a napkin at the bar. Should be quite easy to find.
You missed the rest. Nobody is saying everyone is getting patted down. Im saying if someone suspects you and calls on you the police WILL pat you down and you will get the charge. Maybe you were wearing a camo hat. Maybe a "Winchester" shirt. Maybe it was something they overheard you say. The...
The draft of the law says your training certificate must be carried at all times outside the the home and is good for 2 years. This will be Ann ongoing training requirement. They want you to be too busy or get fed up and say the hell with it and let your permit lapse.
It's not stop and frisk. In any police encounter they have the right to pat down for weapons. This is long upheld. All it takes is a suspicion for there to be an encounter.
Was just going to post along these lines.
What about all of the "this disproportionately affects people of color" talking points? What about the lower income people that won't be able to afford the training classes? They can't exercise their natural rights? So we cant have ID to vote because...
So you're never going to the grocery store again? No grocery store is going to post a guns allowed sign. This is not realistic. We need to get serious.
